Terms of Service

Please read these Terms of Service carefully before using the DigiDukan Hub platform. By signing up or continuing to use our Service, you agree to these terms. We've written them in plain language wherever possible.

1. Acceptance of Terms

By accessing or using the DigiDukan Hub platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

DigiDukan Hub provides a multi-tenant SaaS platform offering digital storefront hosting, headless widget APIs, online catalog management, WhatsApp order forwarding, and related merchant tools for Indian retail and hospitality businesses. We offer three subscription tiers — Starter (₹399/month), Growth (₹999/month), and Pro (₹2,999/month) — each with distinct feature sets as described on our Pricing page.

3. Account Registration & Security

You must provide a valid 10-digit Indian mobile number to register. Authentication is performed via a 4-digit OTP sent to your registered number. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@digidukan.hub if you suspect unauthorised access. We reserve the right to terminate accounts that violate these Terms.

4. Subscriptions & Billing

Subscriptions are billed monthly in advance via Razorpay payment links. Payments are non-refundable except where required by applicable Indian law. Failure to pay within 7 days of the due date may result in service suspension. We will send renewal reminders via WhatsApp at least 3 days before your billing date. Prices may change with 30 days' notice via email or WhatsApp.

5. Merchant Data & Multi-Tenancy

Your business data (catalog items, bookings, customer contacts) is stored in a logically isolated partition identified by your unique tenant_id. We implement row-level security controls to prevent cross-tenant data access. You retain full ownership of your business data. Upon account termination, you may request a data export within 30 days. After that period, data may be permanently deleted.

6. Headless Widget Usage

If your plan includes the Headless Widget Engine (see the Pricing page for which plans include it), you may embed the provided JavaScript snippet on your own website(s). You agree not to reverse-engineer, redistribute, or sublicense the widget code. The widget must be used solely for displaying your own business catalog and accepting reservations. Misuse that affects platform performance for other tenants may result in immediate suspension.

7. Prohibited Uses

You agree not to: (a) use the Service for any unlawful purpose or in violation of Indian law; (b) upload content that is defamatory, obscene, or infringes third-party intellectual property; (c) attempt to gain unauthorised access to other merchants' data or system components; (d) use automated bots to scrape or stress-test the platform; (e) resell or white-label the Service without a written reseller agreement; (f) transmit spam or unsolicited communications through our WhatsApp integration.

8. Intellectual Property

All platform software, UI designs, APIs, and documentation are the exclusive intellectual property of DigiDukan Hub and its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your active subscription. You may not copy, modify, distribute, or create derivative works from any platform component without prior written permission.

9. Service Availability & SLA

We target 99.5% monthly uptime for hosted storefronts and headless widget endpoints. Planned maintenance windows will be communicated at least 24 hours in advance. We are not liable for outages caused by third-party providers (Razorpay, Twilio, AWS infrastructure) or force majeure events. Credits for downtime beyond SLA thresholds will be applied to the following billing cycle upon verified request.

10. Limitation of Liability

To the maximum extent permitted by Indian law, DigiDukan Hub's aggregate liability for any claims arising out of or relating to these Terms shall not exceed the total fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or business opportunities, even if advised of the possibility of such damages.

11. Termination

Either party may terminate the agreement with 30 days' written notice. We may terminate immediately for material breach, including non-payment, illegal use, or violation of Section 7. Upon termination, your access to the Service will cease and your subdomain will become inactive. Data export requests must be submitted within 30 days of termination.

12. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore, Karnataka. Nothing herein prevents either party from seeking injunctive relief in a court of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via WhatsApp notification and/or email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
